SPRINGFIELD, Ill. (AP) ? Illinois authorities took the unusual step of searching guards and other prison employees for contraband as they left at least seven facilities last week, sparking worker allegations that the checks may have been reprisals for complaints about overcrowding and understaffing and inside information leaked to the news media, workers and union officials told The Associated Press.

Department of Corrections spokeswoman Stacey Solano would not confirm that the searches had intensified, but she said they are a routine security measure to control banned materials from cellphones to weapons.

The dustup over the pat downs comes as Gov. Pat Quinn pushes a cost-cutting plan to shutter several state correctional facilities, including next month's scheduled closure of a "supermax" prison in Tamms. The move has been fiercely resisted by prison workers who fear increased violence if currently isolated gang members are moved elsewhere.

The searches began just days after prison workers complained publicly in Springfield about prison conditions and followed a newspaper report about where some displaced Tamms inmates would go. That report was based on an internal Corrections document.

The employees' union said such searches are rare and may constitute "retaliatory harassment," which the Corrections agency denied.

Employee searches started July 23 at prisons in Danville, East Moline, Pontiac and Taylorville; the Menard prison in Chester; the Shawnee lockup in Vienna; and Illinois River Correctional Center in Canton, according to workers and their union, the American Federation of State, County and Municipal Employees. At least some have occurred when workers punched out.

Illinois Department of Corrections policy allows searches of employees at any time ? beginning, during or ending a shift ? to ensure they are not carrying banned materials, from magazines and cigarettes to illegal drugs and weapons.

But Kim Larson, an accountant at the Danville prison for 12 years, said she never received a pat down before when she left her 7 a.m. to 3 p.m. shift.

"It was weird. Usually, they do it at the beginning of the shift, when we're coming in," she said. "I mean, what are we going to take out?"

She said no one told the employees the reason for the search, which for Larson involved going to a restroom with a female officer, emptying her pockets and undergoing a pat down of her body.

Larson said that type of search, even when arriving at work, is so unusual that she can't remember the last time she had to go through any security measure other than the daily inspection of bags and walk through a metal detector.

Solano would not say where pat downs occurred or the reason behind them.

"The department has full authority to search employees whenever it chooses ... to ensure that employees are not participating in the movement or introduction of contraband inside the facilities," Solano said. "IDOC is vigilant in keeping contraband out of the facilities, and this is one such measure the department is taking to ensure safety and security inside the prisons."

It's conceivable that information leaked from a prison would be in paper form because correctional officers, for instance, don't have continuous access to email. But AFSCME is more concerned that the action may be aimed at gagging staffers.

"Coordinated shakedowns of staff are nearly without precedent in anyone's memory," AFSCME spokesman Anders Lindall said. "To do this at the same time union members are coming forward as whistleblowers to reveal the dangerous consequences of the administration's closure plans reeks of retaliatory harassment."

Solano denied that the department retaliates against staff but said, instead, the agency "encourages employees to use the proper process" for reporting problems to the Office of the Executive Inspector General.

Quinn's announcement of the prison closure plan has been followed by several reports of troubling incidents inside correctional facilities.

The AP reported earlier this month, after tipped by people knowledgeable about the prisons, on a string of violent incidents and an inmate drug overdose in the previous six weeks.

AFSCME members and correctional workers came to Springfield two weeks ago and publicly testified against closing prisons because of inmate overcrowding and understaffing. Illinois prisons currently hold about 48,000 inmates in a system designed for 33,000. The number of employees has fallen from more than 16,000 in 2002 to less than 12,000.

Days after AFSCME's public forum, the (Decatur) Herald & Review reported on an internal Corrections memo that designated nine Tamms inmates for transfer to prisons out of state. That prompted lawmaker complaints that Tamms should stay open because other Illinois prisons couldn't control some of the state's worst criminals.

The Tamms supermax isolates gang leaders and violent troublemakers from the rest of the incarcerated population, stifling problems at other prisons, advocates say. Quinn says it's underused and too expensive and wants it closed, along with a prison in Dwight.

The Decatur report prompted a letter to the newspaper from Corrections executive chief Jerry Buscher. It warned that publishing the information could jeopardize the safety of guards and inmates and would be viewed "as attempting to promote disorder within the prison system."

Buscher sent a similar letter to The Associated Press after a reporter asked Solano about information from internal documents the AP had obtained.

Lindall said corrections officials told AFSCME the pat downs are necessary because officials recently found inmates with cellphones during a search at Stateville prison in Joliet. Solano confirmed authorities found contraband earlier this month at Stateville but would not comment further because an investigation is ongoing.

Toby Oliver, a correctional lieutenant at Tamms who was stabbed by an inmate at Stateville in 1995 and has criticized Tamms' closure, called it "coincidental" that the pat downs began two days after the Decatur newspaper report.

He said he never remembers an end-of-shift pat down.

"What is coming out of the institution seems to be the priority," Oliver said. "You'd think it would be the other way around."

Flag-bearing is tall order for China's Yi

China Wednesday picked NBA basketball player Yi Jianlian to carry their flag at the London Olympics opening ceremony, apparently swayed by his towering height.

Deputy chef de mission Xiao Tian repeatedly praised the 2.13m (seven foot) Dallas Mavericks power forward for being tall, and stressed impressive physical stature was a necessary requirement for China's flag-carrier.

Four years ago, fellow basketball giant Yao Ming carried China's flag at the Beijing Olympics opening ceremony.

"It's Yi Jianlian, he'll be the flag-bearer because he's very tall. He's young and tall," Xiao told journalists.

"He plays basketball, he has a good image and also he's competing in the NBA so for many basketball fans in China he's very famous.

"Of course other athletes were good contenders but we decided Yi will be the flag-bearer."

Yi is entering his third Olympics after forgettable campaigns in 2004 and 2008, when China finished eighth on each occasion.

The 24-year-old, who lacks the huge appeal of now-retired Yao, has represented four teams in five NBA seasons, without winning the championship. He didn't start any games in 30 appearances for the Mavericks this year.

China has several other contenders for the flag-carrying honour, including former Olympic champion hurdler Liu Xiang, tennis star Li Na and badminton world number one Lin Dan.

And Xiao admitted ball sports -- including basketball -- were a weakness for the Chinese team, which topped the medals table with 51 golds four years ago in Beijing.

Asked whether China would ever pick a woman to carry the flag, Xiao said: "It's possible. As I just said, the flag-bearer has to be someone with a good image and has to be very tall."

Fellow delegate Cai Jiadong said China, who arrived at the athletes village on Wednesday, would have a "strong presence" at Friday's ceremony. Some 396 athletes, including 29 gold-medallists, are competing in the Games.

"We feel excited and energetic and we can walk behind a very tall basketball player," said Xiao. "He's more than two metres, so everyone can be happy."

This time around, don't hold your breath. "The recovery is going to work in reverse," says Paul Edelstein, financial economics director at IHS Global Insight. "The rest of the economy is going to have to pick up before housing does."

Over the last few months, the U.S. housing market, though still fragile, has outperformed expectations: Home prices have risen; spending on home construction and home improvements has picked up; in July, home builders' confidence took its biggest jump in nearly a decade, according to the National Association of Homebuilders.

Following most previous recessions, a rebound in the housing market signaled stronger economic growth ahead. Admittedly, home construction makes up only roughly 2% of the nation's economy, but it has typically among the first sectors to pick up following a recession. An average of roughly 50 jobs are created for every home that goes up, says Edelstein, adding that construction stimulates other industries, from lumber to metals to retail.

But as Federal Reserve Chairman Ben Bernanke testified before Congress this week, the economy hasn't gotten any better. And it likely won't for a while, even if the housing market shows signs of a turnaround.

In his second day of testimony to Congress on Wednesday, Bernanke reiterated the central bank's plans to keep its key short-term interest rate near zero until at least late 2014. This follows the Fed's move earlier this month in downgrading its economic outlook, as Europe's ongoing debt crisis rattles markets and a series of tax hikes and budget cuts set to kick in next year threaten to send the U.S. economy back into a recession. The Fed now expects growth of just 1.9% to 2.4%, half a percentage point lower than its April forecast.

Indeed, things look gloomy. And there are a few reasons that may explain why what some are calling an improving housing market isn't likely to translate into stronger economic growth.

For one, residential construction has picked up, but the vast majority of Americans are renting more than buying. In June, housing starts rose by 23.6% to an annual rate of 760,000 units over the same month the previous year, according to the U.S. Commerce Department. Barclays analysts called the increase a "post-crisis high" and the highest level since October 2008. Though a bulk of the increase reflects single-family homes, construction of multi-family units has consistently risen over the past year-and-a-half as more people rent rather than buy, according to Barclays.

Edelstein says this is significant because unlike homebuyers who view their purchase as not only a place to live but also an investment, renters don't exactly feel any richer when they sign a lease. So renting doesn't generate as large of a wealth effect. It remains to be seen if construction of single-family homes continues its upward trend.

And while home sales have picked up during the past few months before existing home purchases fell to an eight-month low in June, that doesn't necessarily signal that the average consumer is feeling any better about the economy. Investors, particularly foreign buyers, motivated by the boom in the rental market, have been buying up distressed homes at bargain prices. It's unclear to what extent investors could support the housing recovery, as tight credit standards have continued to block regular would-be buyers from taking advantage of one of the cheapest times to buy.

Perhaps it's really not that surprising that any rebound in the housing market won't be enough to drive America's economic recovery. After all, as Harvard professors Carmen Reinhart and Kenneth Rogoff argue, economies that have undergone systemic financial crises take much longer to heal than economies responding to normal recessions.

Perhaps we shouldn't read too much into recent news that the housing industry is doing better.

Mental Health Records Are Discoverable in Tennessee Child Custody

Facts: The parties ? parents of two children ?divorced after a six-year marriage. As part of a temporary mediation agreement, each party agreed to participate in psychological therapy. Later, Wife subpoenaed all of Husband?s records from his psychologists. Husband moved to quash the subpoenas on the grounds that the information sought by Wife was not discoverable because it was protected by the psychologist-client privilege. The trial court overruled Husband?s motion and directed that his psychological records be produced subject to a protective order. Husband sought an extraordinary appeal under Rule 10 of the Tennessee Rules of Appellate Procedure.

On Appeal: The Court modified the trial court?s ruling.

Husband argued the trial court erred in ordering the production of his psychological records because his records are protected from discovery by the psychologist-client privilege under Tennessee Code Annotated ? 63-11-213.?When a discovery dispute involves the application of a privilege, the court?s judgment is guided by the following three principles. First, Tennessee?s discovery rules favor discovery of all relevant, non-privileged information. Second, even though privileges do not facilitate the fact-finding process, they are designed to protect interests and relationships that are regarded as sufficiently important to justify limitations on discovery. Third, while statutory privileges should be fairly construed according to their plain meaning, they need not be broadly construed.

Tennessee law recognizes a privilege against compelled disclosure of confidential communications between a psychologist and client.?Specifically, Tennessee Code Annotated ? 63-11-213 provides that:

[T]he confidential relations and communications between licensed psychologist or, psychological examiner or, senior psychological examiner or certified psychological assistant and client are placed upon the same basis as those provided by law between attorney and client; and nothing in this chapter shall be construed to require any such privileged communication to be disclosed.

As indicated by the language of the statute, the legislature chose to treat the confidential communications between a psychologist and client the same as those between an attorney and client.

Given the unique nature of child custody determinations, a parent?s assertion of the psychologist-client privilege to prevent access to mental health records presents a more difficult issue than those raised in other situations involving the privilege. In child custody cases, the paramount consideration is the best interest of the child.?When a custody dispute arises between legal parents, courts must determine the child?s best interests in light of the comparative fitness of the parents,?and must consider numerous factors including, where applicable, the mental and physical health of the parents.

In light of the foregoing, the Court ruled:

Although the best interests of the children remain the focus of the trial court?s concern when making custody determinations, the importance of the confidential relationship between a psychologist and client must not go unnoticed. Therefore, we conclude that the trial court erred to the extent that it ordered disclosure of Husband?s psychological records to Wife without properly considering the application of the psychologist-client privilege or whether Husband waived the privilege. We are mindful, however, of the concerns expressed by the trial court for the best interests of the children in light of the comparative fitness of the parents. Accordingly, on remand Husband?s psychological records shall be disclosed to the trial court for an?in camera?review for the purpose of conducting the comparative fitness analysis. Following this determination, the trial court shall enter an appropriate order protecting Husband?s privileged psychological records.

Alternatively, Wife argued that Husband affirmatively placed his mental health at issue, and thereby waived to the psychologist-client privilege, by seeking an award of sole custody. The Court quickly rejected this reasoning, stating:

If this were the law in Tennessee, there would be no psychologist-client privilege in child custody cases; a party seeking privileged mental health records could obtain them simply by alleging the mental instability of his or her adversary.

Accordingly, the Court vacated the trial court?s ruling and ordered Husband?s psychological records to be produced to the trial court for its private review.

K.O.?s comment: Note the opposite result was reached in Herman v. Herman?when?the Middle Section reversed the trial court?s order that psychological records be produced for in camera review.

What would you rename the Canada Science and Technology Museum?

One idea bandied about during the museum's "visioning" exercise is coming up with a new name.

Something like, the Canadian Science and Innovation Museum.

That's an actual suggestion offered during a museum meeting of a campaign steering team from last March, according to the minutes.

Here's another idea offered during the meeting by Gary Polonsky, chairman of the museum's board of trustees: InnoNation.

It was agreed "extensive research and testing" would be needed if the museum was to find a new name.

The museum's vice-president of public affairs said it's early days to be talking about a name change.

"It's too speculative at this point," Yves St-Onge said in an interview this week.

"The name of the museum is still the name of the museum as it is now."

In many ways, rebranding the museum has roots in the puzzle of financing a new facility.

Part of the challenge for the museum is coming up with an argument for the government to make such a large cultural investment in the nation's capital.

It might be all in the language the museum uses.

For example, the documents suggest it's trying to add the word "innovation" to the "science and technology" theme.

That could sync with the feds' focus on boosting the economy.
